THIS INDENTURE made the Nineteenth Day of November Anno Domini One Thousand Seven Hundred and thirty Six BETWEEN John White of the City of Philadelphia in the Province of Pennsylvania Merchant of the One Part, and Henry Moler of the County of Lancaster in the sd Province Yeoman of the other Part
WHEREAS John Penn Thomas Penn & Richard Penn Esqrs. True & Absolute Proprietaries of the sd. Province by a certain Patent under the Hand of the said Thomas Penn & their Great Seal bearing date the twelfth Day of June Anno Domini One thousand Seven hundred & thirty four for the Consideration therein mentioned Did with other Land grant and confirm unto the said John White (in right of a Certain Grant made by the late Proprietary William Penn Esqr. Unto James Joseph & Benjamin Crispin, Jane Eleanor Elizabeth & Amy Crispin the Children of Captin William Crispin late of Kingsale in Ireland deceased by Deed dated the Eighth Day of August Anno Domini One thousand Six hundred and Eighty Seven and now Vested in the said John White) A Certain Tract of Land Situate in the sd. County of Lancaster Containing One thousand Six Hundred and forty Seven Acres and the Allowance of Six Acres on every hundred for Roads & Highways To Hold to him the sd. John White his Heirs & Assigns forever Paying therefore Yearly to the sd. Proprietaries their Successors at the Town of Lancaster at or upon the first Day of March in every Year from the first Survey thereof two English Silver Shillings for every hundred Acres or the Value thereof in Coin Current as by the said Patent Recorded in the Office for Recording of Deeds for the City and County of Philadelphia in Patent Book A. Vol. 6. Page 349 &c. the Second day of July One Thousand Seven Hundred and thirty four may more fully Appear
NOW THIS INDENTURE WITNESSETH that the sd. John White for and in Consideration of the Sum of one hundred and ten pounds five Shillings of Lawful Money of the sd. Province to him in hand paid by the sd. Henry Moler the receipt whereof he doth hereby Acknowledge and thereof doth acquitt and forever discharge the sd. Henry Moller his Heirs and Assigns by these Presents Hath Granted bargained Sold Aliened Enfeoffed released & confirmed and by these Presents Doth grant bargain Sell Alien Efeoff release and confirm unto the said Henry Moler his Heirs & Assigns
All that Piece or Parcel of Land Situate in the sd. County of Lancaster BEGINNING at a White Oak by Cocolico Creek at a Corner of Jacob Graffs Land thence South fifty two degrees West by the Land of Jacob Hayne thirty Perches to a Hickery by the said Creek then down the same on the Several Courses thereof One hundred & thirty two Perches to a Black Oak thence South West by the Land of Henry Creibill Ninety Perches to a post thence South East by South One hundred and Twenty Perches to a Chestnut Tree thence East by South One hundred and fifty Perches to a Black Oak thence North fourty Degrees East Ninety five Perches to a post thence North Eighteen Degrees West by the land of the said Jacob Graff one hundred & Eighty two Perches to the Place of Beginning Containing two hundred & forty five Acres and the Usual Allowance for Roads. Being part of of the sd. Tract of Sixteen Hundred & forty Seven Acres
TOGETHER with all the Woods Meadows Ways Waters Watercourses rights Liberties Priviledges Improvements Hereditaments & Appurtenances Whatsoever to the sd. Piece or Parcel of Land and Premises hereby Granted belonging or in any wise Appertaining (Of all which sd. Piece or Parcel of Land & Premises hereby granted to the sd. Henry Moler is now in Actual Possession by Virtue of a Bargain and Sale to him thereof made by the sd. John White for the Term of One Year from the Day next before the day of the date of these Presents as by Indenture in that behalf made bearing date the Day next before the date hereof may appear) And the Reversions & Remainders rents Issues & Profits thereof And all the Estate & Interest Whatsoever of him the said John White of in & to the hereby Granted Premises And true Copies of all Deeds Evidences and Writings Concerning the same to be had and taken at the Charge of the said Henry Moler his Heirs or Assigns
TO HAVE AND TO HOLD the sd. Described Piece or Parcel of Land hereditaments & Premises hereby Granted & released or mentioned so to be and every part thereof with the Appurtenances unto the said Henry Moler & his Heirs to the Use of him the sd. Henry Moler his heirs & Assigns forever
UNDER the Proportionable Part of the Yearly Quit aforesaid hereafter Accruing for the same to the Chief Lord or Lords of the ffee thereof And the said John White & his Heirs the said Described Piece or Parcell of of Land & Premises hereby granted & Released or mentioned so to be & every Part thereof with the Appurtenances unto the sd. Henry Moler his Heirs & Assigns Against him the said John White & His Heirs and Against all & every other person and Persons Whatsoever lawfully Claiming or to Claim the hereby Granted Premises Shall and will Warrant & forever Defend by these Presents And the sd. John White for himself his Heirs Executors & Administrators doth Covenant Promise and grant to and with the said Henry Moler his Heirs and Assigns by these Presents that the said John White and his Heirs & all and every other Person & persons whatsoever having or Lawfully Claiming or that shall or may at any time or times hereafter so have or claim any Estate right Title or Interest of in or to the hereby granted Premises or any part thereof by from or under him them or any of them shall and will at any time or times hereafter upon the Reasonable Request Costs and Charges in the Law of the sd. Henry Moler his Heirs or Assigns make Execute & Acknowledge or cause so to be all & every Such Further & other reasonable Act and Acts Deed or Deeds Device or Devices in Law Whatsoever for the further & better Assureance and Confirmation of the sd. Described Piece or Parcel of Land hereditaments & Premises hereby granted & Released or mentioned so to be and of every or any part thereof with the Appurtenances unto the sd. Henry Moler his Heirs & Assigns as by him or them or by his or their Council Learned in the Law shall be reasonably Devised Advised or Required And that he the said John White is the Sole and Lawful Owner and Proprietor of the sd. Land & Premises hereby Granted and is Seized thereof in his own Right as of an Indefeazibil Estate in fee Simple without any Condition Limitation or other Clause Matter or thing to Alter Change Defeat or make void the same And that he the sd. John White now hath good right full power Lawful & Absolute Authority to Grant & Convey the said two hundred & forty five Acres of Land with their Appurtenances unto the sd. Henry Moler his Heirs & Assigns In Manner aforesaid and that the said Granted Premises with the Appurtenances now are & from henceforth forever hereafter shall remain & Contin unto the sd. Henry Moler his Heirs & Assigns free and Clear & freely & Clearly Acquitted & Discharged of and from all and all manner of former and other Bargains Sales Gifts Grants titles Estates Claims & Demands Arrearages of Rents and other Incumbrances Whatsoever IN WITNESS whereof the sd. This is to Certifye that on the tenth Day of December Anno Domini 1767 Personally came before me Emanuel Carpenter one of his Majesty's Justices of the Peace for the County of Lancaster Samuel Weiser and Benjamin Weiser and on their Solemn Oath do Declare and Say that they are are well acquainted with the hand Writing of Conrad Weiser one of the Witnesses to the within Deed and they are very certain that the name of Conrad Weiser is of his own Proper hand Writing as a WITNESS to the Within Deed IN WITNESS whereof I have hereunto set my hand and Seal.
